What is the claim about?These claims are about the recovery of "secret commissions." It is common practice for energy suppliers to pay energy brokers a commission for every energy contract the broker arranges on behalf of its clients. In many cases, the end customer would not be told about the commission but would absorb its cost by paying higher energy rates. In most cases, these payments will be unlawful, and will amount to bribes paid by the supplier; as a result the customer is entitled to the repayment of the bribe, plus interest and damages. In short, the legal basis of the claim is that the payment made by your supplier to your energy broker amounted to a bribe. Where a broker owes you a duty to provide recommendations on an impartial and disinterested basis, the acceptance of a commission conflicts with this duty as it makes it more likely that the broker will recommend the contract through which the largest commission will be paid, rather than the most suitable contract for you. If your broker obtained your fully informed consent to them accepting such a commission, there will be no claim. Where no informed consent was given, there will be a claim for compensation.

Which companies may have mis-sold business energy?According to Ofgem, the industry regulator, mis-selling has occurred in nearly all energy companies, regardless of how big or small they are. This includes the traditional "Big 6" energy companies like British Gas, ScottishPower and EDF Energy, as well as newer energy companies like OVO Energy and Octopus Energy.

How much can I claim?The average business energy refund claim ranges between £20K and £50K. Even for smaller businesses the refund claim value ranges between £10K and £15K. The value of your refund will depend on the hidden commission charged, the length of your contract, and your energy consumption during that time. The average contract length is 3 years. Often, brokers encourage clients to opt for longer-term contracts, predicting market increases over time. Yet, they often favor longer-term contracts as the commission they earn multiplies with the contract length, typically leading to a larger claim amount.

How long does a claim take?This really depends on a number of factors and it is difficult to say exactly how long your claim will take. One factor we're sure you can relate to is the time it takes for your energy supplier to respond to requests for information but, rest assured that we are very diligent on your behalf. We have had claims get settled within 4 weeks, and others may take a number of months, from the time that you authorise us to act on your behalf.

What is a Letter of Authority or LoA?A Letter of Authority (LOA) is a legal document that allows customers to authorise someone to act on their behalf within agreed limits. Our Letter of Authority template gives our team the authority to speak to your energy suppliers on your behalf. LOAs give customers confidence that the person they’ve appointed knows what they are authorised to act upon, whether it’s account information, billing details or personal information related to their business.

What is an Energy Broker?An energy broker is an organisation or individual that gives energy-related advice, aimed at helping you to buy energy and/or manage your energy needs. Note that it's quite possible to have spoken to a broker representing an energy provider without that particular fact having been disclosed.

How can I check if my contract was handled by a broker?Typically, an energy contract will contain details of the broker that processed your contract. Most contracts will have the details of the broker on the right hand side of the first page, while others may have the information on the back of the contract. Our experienced claims consultants will check this information so you don't have to.
